We kindly request that you carefully read this agreement in full before you access or use the services and information provided through the CVid website (“Site”). By accessing or using the Site, you agree to be bound by the terms and conditions contained below. CVid may modify this agreement at any time, with any such modification taking effect immediately on posting on the Site.
Copyright and trademarks
All material and trademarks on this Site are owned by TechBrain Pty Ltd (“CVid”). You agree not to infringe any intellectual property rights owned by CVid.
Site information strictly for non-commercial
You acknowledge and agree that all information contained on the CVid site is for personal use only. You may not use the information for redistribution, sale or any commercial purpose including but not limited to unsolicited commercial correspondence. You are entitled to download site content on the strict understanding that you agree to keep all copyright intact and use the content for personal non-commercial use only.
Unless you receive the prior written consent of CVid you must not use any tools to create, maintain, enhance or reproduce information contained on the CVid site in any other location including but not limited to the internet.
You must not use this Site for any unlawful purpose or in any way that is prohibited by these terms of use. Modifying, copying, reproducing, uploading, distributing and transmitting any information contained on this Site in any way is strictly prohibited.
CVid not providing professional advice
In accessing the CVid site you agree that any information provided is general in nature and not intended to be relied upon. Obtaining independent advice relating to legal, taxation, financial or accounting is highly recommended. You bear sole responsibility for assessing and evaluating the completeness, relevance and accuracy of all information contained on the CVid site and the sites linked to and from it and full liability for any decision made as a result of that information.
Under no circumstances will CVid be held liable to anyone as a result of any decision made based on information contained or not contained on the CVid site.
Our rights to use information you send us
As part of our culture of continual improvement CVid encourages you to express your ideas and information about the Site. In doing so you agree that CVid may, at no cost, use as it sees fit any idea or information you submit or express (including ideas for new or improved products and services) regardless of how it is submitted or expressed. No guarantees of external sites linking to us or linked from us
CVid provides, as a convenience, links to websites owned by third parties. CVid has no control of these sites and as such does not endorse the content or guarantee their products or services including their accuracy or legality. You take full responsibility for any and all copyright compliance as it relates to the sites linked to and from CVid. You unreservedly agree that CVid will not be held liable for any damages or loss arising out of or in connection with or incidental to any information or service provided by any third party.
Limitation of Liability
CVid will take all due care with the information you provide, however it is possible that information will be observed by a third party. To the extent permitted by law, CVid disclaims all liability and gives no warranty with respect to the privacy and integrity of the information you provide and CVid you agree that CVid will not liable for any damage or loss however so arising.
Username and password responsibility
You will be asked to provide a username and password to become a registered user. CVid takes no responsibility for this username and password including maintaining its confidentiality and the activity that occurs under your username. Should you become aware of any unauthorised use of your login you agree to immediately notify CVid. You may change your password at any time by contacting customer service or following the instructions on the website.
Indemnification
You agree to indemnify CVid against any claim for damage or loss arising from the use of the Site. You acknowledge that CVid does not guarantee an error free, uninterrupted service through the Site and CVid provides no warranty to you that files available through the Site, regardless of how they are accessed, will be free of worms, viruses or infections or other contaminating code or that you data will be secure. The responsibility for implementation of adequate procedures and security to protect you when accessing the Site rests entirely with you and you absolve CVid of any responsibility in this regard.
Privacy
CVid has a comprehensive Privacy Policy that it will comply with. A copy of the Privacy Policy can be obtained at www.cvid.co. If the personal information requested by CVid is not submitted, the appropriate services may not be provided. Your proceeding to access the Site and deal with CVid is confirmation that you accept Privacy Policy.
Misrepresentations prohibited
You agree that you use of the CVid Site, CVid Application and any other services provided by CVid is conditional upon you not misleading or deceiving others either by any act or omission (including but not limited to creation of a profile on the CVid Site or Application).
Termination
Termination of this agreement will not end those provisions that are capable of surviving the ending of this agreement.
Severance
If any condition covenant or stipulation of this Agreement or the application thereof to any person or circumstance shall be or become invalid or unenforceable, the remaining covenants conditions and stipulations shall not be affected thereby and each covenant condition and stipulation of this Agreement shall be valid and enforceable to the fullest extent permitted by law.
Governing Law
This agreement shall be governed and construed under and in accordance with the laws of Western Australia. The parties hereto submit to the non-exclusive jurisdiction of the West Australian Courts.
Notices
Notices are deemed delivered in the event they are delivered in person, or sent by post, facsimile or email to your business, home or postal address last known to CVid.
Cancellations
All orders are 100% non refundable.
Definitions
In this agreement unless the words “CVid”, “TechBrain”, “We”, “Our” and “Us” refer to TechBrain Pty Ltd and the word “Site” to content delivered on www.cvid.co.
